Precedent
An earlier court decision that guides how later cases are decided.
Definition
Precedent (or binding precedent, stare decisis) is the principle that courts must follow decisions of higher courts in the same jurisdiction when the legal issues are the same. Only decisions of courts at or above a certain level are binding — persuasive precedent from other courts or jurisdictions may be considered but need not be followed.
