Witness
A person who tells the court what they saw, heard or know.
Definition
A witness is a person who gives evidence in court proceedings, either in writing (a witness statement) or orally (giving testimony). A witness must take an oath or affirmation that their evidence is true. An expert witness is a specialist instructed to give opinion evidence on technical matters.
In practice
Witness statements must be prepared carefully — the court will assess the credibility of each witness. Statements should be in the witness's own words.
